If we cannot resolve the dispute informally within 30 days, any dispute, claim, or controversy arising out of or relating to these Terms of Service, your use of the Service, or your purchase of any product, shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Class Action Waiver
You and CaseHutch agree that any dispute resolution proceeding will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit, class-wide arbitration, or any other representative proceeding against CaseHutch.
Exceptions
Notwithstanding the above, either party may bring an individual claim in small claims court, and either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights.
Opt-Out Right
You may opt out of the arbitration agreement and class action waiver by sending a written opt-out notice to support@casehutch.com within 30 days of first accepting these Terms.
Your opt-out notice must include your full name, mailing address, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms of Service.
